DMCA Policy

1. Our commitment
Smartronics LLC ("we") respects the intellectual property rights of others and expects our users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
2. How to submit a DMCA takedown notice
If you believe that material on the Site infringes a copyright you own or control, you may submit a written notice to our designated DMCA agent. To be effective under the DMCA, your notice must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works at the Site are covered by a single notice, a representative list of those works);
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed, with information reasonably sufficient to permit us to locate the material (a URL to the specific page is helpful);
- Information reasonably sufficient to permit us to contact you, including your address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Notices that do not substantially comply with these requirements may not be effective under the DMCA and may be disregarded.

Important: To receive the benefit of the DMCA safe-harbor provisions, an online service provider must register its designated agent with the U.S. Copyright Office. Smartronics LLC will complete this registration before the Site launches. The current registration can be verified at the Copyright Office’s DMCA Designated Agent Directory.
4. Counter-notice procedure
If you believe that material you posted on the Site, or that we removed in response to a DMCA notice, was misidentified or removed in error, you may submit a counter-notice to our designated agent. To be effective, your counter-notice must include all of the following:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notice or that person’s agent.
If we receive a valid counter-notice, we will forward it to the party who submitted the original DMCA notice. The DMCA process then allows that party 10 to 14 business days to seek a court order. If they do not, we may restore the material.
5. Repeat infringer policy
It is our policy, in appropriate circumstances and at our discretion, to terminate access to the Site by users who are determined to be repeat infringers of others’ copyrights.
6. Good faith and accuracy
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material on the Site is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees incurred by us or the alleged infringer. If you are not certain whether material infringes your copyright, you should consult an attorney before submitting a notice.
